European Commission publishes Communication on e-commerce

On 11 January, the Commission presented a Communication on the e-Commerce Directive (Directive 2000/31/EC) which puts forward 16 targeted initiatives aimed at doubling the share of e-commerce in retail sales and that of the Internet sector in European GDP by 2015.??While the Communication mainly focuses on removing remaining barriers in the Internal Market in order to boost e-commerce, the text makes reference to the following:
  • The Commission recalls its support for self-regulatory efforts in order to ensure compliance with the implementation of the provisions on cookies in the e-Privacy Directive. It gives criteria that self-regulatory schemes will have to meet to comply with the ePrivacy Directive.
  • The Commission will present new initiatives in the area of behavioural advertising in the first quarter of 2012.
  • The forthcoming review of the Data Protection Directive will address "fears about the use and standard of protection of personal data” in the context of behavioural advertising.
  • The Communication also touches on the important question for brand owners of the liability of intermediary internet providers.

Next steps: The Commission does not intend to revise the e-commerce Directive but will carry out an in-depth evaluation of its transposition in 2012. The Communication will now be transmitted to the Council of Ministers and the European Parliament. The Parliament should adopt a non-binding opinion.
